Shipping & Returns

Due to the restrictions of many state laws, delivery of wine is limited to those states where direct shipment is permitted by law. At the present time, shipment is permitted to all states except KY and UT.  Certain states have special restrictions and fees:

AL: wine  must  be  delivered  to  a  state  store  for  an  additional  fee  of approximately $4 per case of 12 bottles.
NH: charges a state tax of 8% of the total value of the wine for direct shipments to consumers
AK, HI and IL: require additional fees of approximately $100/case.

In addition, some winemakers have exclusive distribution agreements that may interfere with BurgDirect’s ability to make deliveries in selected geographies.  These restrictions will be set forth within each offer when they apply.

All packages are shipped using FedEx, UPS and GSO (where available) and our shipping prices include packaging materials. A cold chain shipping option (for delivery in seasons/locations where the temperature is too high for normal delivery) is available at an added expense.
You will be notified by email when your wines are shipped. Generally, our shipper will attempt to pick up your wine and ship it shortly after your order is placed. Because the wines must be collected from the winemakers in France, then imported into the United States before being processed and sent to you, the usual time from order to delivery is expected to be six to eight weeks.  However, in some instances your order may be delayed several additional weeks before the shipper can pick up and deliver your wine to you.  For example, in an effort to protect your wine, shipment of your order may be delayed until it can be shipped in ideal weather and shipping conditions.

Due to ever changing direct-shipping laws and regulations, the list of states to which your wine may be shipped might change at any time. All wines are sold in France at the domain’s cellar door and title passes to you in France. We will arrange for shipment on your behalf, to an address that you specify, provided that in our sole discretion we believe that such shipment will not subject us to the risk of any sort of legal action or other harm. If you live in a state where the direct shipment of wine may violate the law, we will contact you to discuss shipping options, which may include your giving us an alternative shipping address in a state where the direct shipment of wines to consumers is permitted or our making an agreement between us for the storage of the wine at an acceptable third-party storage facility.

All wines sold are maintained at optimum conditions. The wine you buy from our participating wineries is out of our control once it has been handed over to the shipper in France and neither the winery nor BurgDirect is responsible for improper storage after it has been transferred to the shipper. Once your wine order has been picked up by the shipper or other common carrier for delivery, the wine becomes your responsibility. When you buy wine through BurgDirect, you are also buying shipping insurance through the shipper. If your wine is damaged during shipment, you have the right to make a claim against the shipper and its insurance. BurgDirect not responsible for, and will not replace, wine that is damaged by extreme weather conditions during shipment. We cannot accept returns for the following: wines that do not coincide with your personal tastes, wines that have been adversely affected by customer storage, and wines that have been damaged as a result of any other adverse condition occurring while the wines are in your care.

If your wine is shipped back to the winery from which you purchased it, we will refund your credit card for the offered price of the wine less the costs of shipping and handling. If you did not receive the wines you were offered and paid for, you will receive a full refund, including all shipping, insurance, and handling charges.
